What is RERA Registration ?

 

RERA registration is the entry of real estate projects or a real estate agent with Real Estate (Regulation and Development) Act, 2016 (RERA. The RERA has been launched by the Government of India to facilitate transparency, accountability, and efficiency in the real estate sector.

 


 Purposes of RERA Registration

The following are the core purposes of RERA registration:

 

1. To secure the rights of homebuyers

2. For greater transparency between the homebuyers and real estate agents.

3. The project should be completed in time.

4. Redressal mechanism of grievances should be available.

 

Who Needs RERA Registration?

1. Real Estate Developers/PromotersIn case the size of land is above 500 square meters or in case the number of units in a project exceeds eight, then the developer is liable to get that particular project registered under RERA.

2. Real Estate Agents: If an agent engages in the sale/purchase of properties that are registered under RERA, then the agent shall also need to get himself registered under RERA.

Consequences of Not Registering

In case a project or an agent has not registered with RERA, then there are some implications such as fines or imprisonment or both depending on the state-specific rules and gravity of non-compliance.

The Real Estate (Regulation and Development) Act, 2016 (RERA) is a legislation enacted by the Government of India to regulate the real estate sector. Certain provisions have been made in this regard for the registration of real estate projects and agents. The following are relevant provisions of the Act in regards to RERA Registration



Major Provisions Regarding RERA Registration


1. Section 3: Pre-registration of Real Estate Projects
- Prohibition, The promoters cannot advertise, market, book, sell or offer any real estate project without prior registration with the RERA authority.

- Exceptions
- Projects with land area less than 500 square meters or less than 8 apartments
- Projects completed before the commencement of RERA.
- Repair or renovation projects without provision or sale of new units.

2. Section 4: Application for Registration of Projects
To be presented
- The Name and profile of the Promoter
- Information regarding the Project (Sanctioned Plan, address of the site, Type of Apartment).

- The Date on which the said project will be accomplished
- Allottments of the fund as to the projects.
- The application will be issued a fixed fee along with documents.

3. Section 5: Grant of Registration
- TimeThe RERA authority shall approve or reject the registration within a period of 30 days from the date of receipt of the application.

- On approval, a Registration Number is given.


4. Chapter 9: Registration of Real Estate Agents
- The duty: No agent will deal with or enable sale/purchase of any properties in the projects which are not registered under RERA.
- Agents shall make and must obtain a distinctive registration number.

Chapter 10: Functions of Registered Real Estate Agents
- Maintain accounts and records of real estate related transactions.
- Shall not indulge in unfair trade practices;
- Shall follow such guidelines formulated under RERA.

6. Chapter 11: Obligations of the Promoter
a. The promoter shall furnish details of projects on RERA website.
b. Shall update project status periodically.

Penalty for Failure
1. Section 59:
Punishment for Failure to get the Projects Registered 
Punishment of  10% of the approximate cost of the project.
- Continuing contravention:  Punishable by imprisonment of   3 years in addition to a fine, which shall not be less than 10% of the cost of the project.


2. Section 62: Punishment for Failure to register projects by Agents
- Penalty up to 10,000 per day for the default period that may reach 5% of the cost of the project

3. Section 61: General Penalty for Non-Compliance
For every default under the Act, up to 5% of the project cost shall be recovered as penalty.


4. Section 70: Punishment for Furnishing False Information
Up to 5% of the project cost fine.

1. For Developers:

Surf through the state RERA portal related to the developer's state.
Online form to submit which carries all the information related to the project
Documents which needs submission of ownership proof for land and its approval which also includes financial related proofs.

Registration: To register projects, agents, or complaints.

Search Tools: Discover registered projects, agents or complaints.

Login/Registration: For first time users, use either "Login" or "Sign Up".

Enter personal or business information (whatever is applicable).

 

Step 3: Services Available by UP-RERA

Registration of Projects:

For real estate projects, their developers have to get it registered.

Use the option of "Project Registration" for this purpose and enter details.

Registration of Agents:

Under RERA, real estate agents have the mandatory requirement to get self-registered.

You may use the option "Agent Registration".

 

Complaint Filing:

 

To raise complaint against builder/agent

Go to "Complaint Registration"

Complete all the details to fill the application, attach the supporting documents for complaints and pay complaint amount.

Search Registered Projects/Agents

 

Utilize "search" to find project and agents status. Find them through the project name/promoter name or by registering number.

Track Complaint

 

You can check status about a complaint filed through your complaint number.
